TX Court Invalidates QPA Portion of Final Rule under the NSA for the Second Time
A Texas Federal District Court has moved swiftly in the most recent lawsuit filed by the Texas Medical Association (TMA) ruling in favor of the Association. The Court, for a second time, has invalidated the qualifying payment amount (QPA) rule under the No Surprises Act (NSA). The Court agreed that the Final Rule issued in August of 2022 by the Departments of HHS, Treasury and Labor continues to give a weighted consideration to the QPA in the independent dispute resolution (IDR) process that unfairly benefits insurers.
